1.2 Your use of this website and any transactions with this website is at all times subject to these Terms and Conditions as applicable to your use of the website and all applicable laws. By accessing our website you agree to our Terms and Conditions set out below. If you do not agree to these Terms and Conditions, you must exit our website immediately.

1.3 We reserve the right, from time to time, with or without notice to you, to change these Terms and Conditions at our sole discretion. The Terms and Conditions applicable to your access to and use of this website will be the version that is current and displayed on the website as at each date you access the website. Your use of the website after changes are made will imply that you agree to be bound by such changes.

1.4 Details of any purchases you have made will be made accessible via links provided in automatic emails and by logging in to the site where a list of purchases will be provided.

1.5 Account Details

1.5.1 It is your responsibility to remember the email address you gave when purchasing items and to have the ability to check and read email that is sent to this account.

1.5.2 In order to log in and see previous purchases or access purchased downloads you will require the registered email address and a password of your own choosing.

1.5.3 We will allow the requesting of passwords to the registered email address at a maximum of one per day where upon we will send an email with details of your email address and password to the registered email address.

1.5.4 It is your responsibility to keep your email address and password combination private. If we detect that multiple people are accessing your account then we reserve the right to block access to your account.

2.1 You agree not to upload, post, email or otherwise send or transmit any material that contains software viruses or any other computer code, files or programs designed to interrupt, harm, damage, destroy or limit the functionality of any computer software or hardware or equipment linked directly or indirectly with this website. You also agree not to interfere with the servers or networks underlying or connected to this website or our services or to violate any of the procedures, policies or regulations of networks connected to this website.

2.2 You agree not to impersonate any other person while using this website or use the website for any illegal purpose.

3.1.1 All material available on this site without logging in or paying for download specific materials is provided free of charge.

3.1.2 Ex Libris Records holds the copyright on all the material provided on the site.

3.1.3 All provided material may be used and copied freely for personnal use or where the distribution medium is free, such as the internet or free cd's.

3.1.4 Using any material on this site for purposes of profit is expressly forbidden unless we give written permission for you to to do so.

4. Payment for Downloads

4.1 Registration and Payment Process

4.1.1 To buy an album to download you will have to provide us with a valid email address and a password.

4.1.2 You agree to keep your password private and not choose a password that you know other people are aware of.

4.1.3 If we detect multiple people downloading tracks we withold the right to suspend your account until the password is changed.

4.1.4 Upon receiving confirmation of payment for a download we will provide you with access to the media to download.

4.1.5 Confirmation of payment will be when we receive a payment confirmation from NoChex in accordance with their Terms and Conditions.

4.2 Access To Downloaded Media

4.2.1 We will send an email to the provided email address with links to private pages on the website.

4.2.2 You agree to not publish or otherwise distribute these provided links.

4.2.4 Alternatively the same pages can be reached by logging in to the site in accordance with section 1.5.

4.2.5. These pages will allow the download of tracks in four formats, MP3 at 128 KBit rate downloadable per track, MP3 160 KBit rate downloadable as a ZIP archived file, MP3 at 256 KBit downloadable per track or FLAC (Free Lossless Audio Codec) downloadable per track.

4.2.6 We will allow the files to be downloaded up to three times per purchase per file only.

4.2.7 We reserve the right to allow further downloading of the files if you contact us giving a reason as to why you need to download the songs again.

4.2.8 The files and the website will be available on a standard website and we will endevour to provide a consistent and quick download service.

5. Payment for CD's or Merchandise

5.1 Registration and Payment Process

5.1.1 You will provide us with your email address, a password, your name and address.

5.1.2 It is your responsibility to provide us with a valid address and name.

5.1.3 We will only permit shipping of a purchased item to the registered billing address of the payment method used and as indicated to us by Nochex.

5.1.4 All products will be shipped within 7 working days of payment being confirmed by NoChex, although we will aim to despatch products within 3 working days.

5.1.5 Should an item you buy not be available we will offer a choice of immediate full refund or delivery within a specified period.

5.1.6 If an item is not available you will be contacted within 7 working days of payment being confirmed by Nochex.

5.1.7 We will attempt to ensure that stock is available for any items which are available for purchase.

5.2 Delivery

5.2.1 All Items will be sent by registered postal service with a guarenteed delivery time of 48 hours.

5.2.2 Upon non delivery of any purchased item, we will request confirmation of delivery from the postal service.

5.2.3 If an item is undelivered we will offer via email a full refund or a replacement item to be sent immediately.

6. Returns

6.2.1 If you are not happy with a piece of merchandise or media that you have bought from us then upon returning the item we will issue a full refund within 7 working days of us receiving the item.

6.2.2 If it is not possible for you to download a purchased album and have not already downloaded it or it is not possible for us to supply certain media or merchandise then we will offer a refund for any purchased item, to be paid within 7 working days.

6.2.3 If you have some reason for wanting a refund for a purchased item that you cannot or will not return or a purchased download then please email us@exlibrisrecords.co.uk and we may decide at our discretion to offer a refund.
